1. General Provisions
1.1. These terms and conditions define the rules for using the online store operated by Overrevel Daria Gocel with headquarter at 90-135 Łódź, ul. Prezydenta Gabriela Narutowicza, nr 40, lok. 1, NIP: 7282859948, REGON: 521315370.
1.2. The online store sells products exclusively online.
1.3. Using the store signifies acceptance of these Terms and Conditions.
2. Definitions
2.1. Customer – a natural person or legal entity using the online store.
2.2. Seller – Overrevel Daria Gocel.
2.3. Products – goods available in the online store intended for sale.
2.4. Sales Agreement – a contract for the sale of products concluded between the Seller and the Customer via the online store.
3. Placing Orders
3.1. Orders can be placed by natural persons with at least limited legal capacity and by legal entities.
3.2. Purchases in the store can be made without registering a user account; however, account registration offers additional benefits such as easier returns and free shipping upon meeting certain conditions.
3.3. All prices listed on the website are gross prices and include VAT.
3.4. The Customer has the option to cancel the order until the goods are dispatched. After the shipment has been sent, the Customer may exercise the right to withdraw from the contract within 14 days from the date of receiving the goods.
3.5. The Seller is obliged to deliver goods free from defects. In the event of discovering physical or legal defects, the Customer may exercise the rights under the warranty in accordance with the Civil Code.
4. Payments
4.1. Payments for purchases are made exclusively online through payment partners such as Stripe, Płatności24 and others.
4.2. The store reserves the right to refuse to process an order if the payment is not properly recorded.
4.3. All product prices in the store are given in Polish zloty (PLN) and include VAT.
5. Order Cancellation by the Store
5.1. The store reserves the right to cancel an order in case of lack of product availability or significant pricing errors resulting from an obvious mistake. In such cases, the Customer will be promptly informed, and any payments made will be refunded within 14 days.
6. Delivery and Shipping Costs
6.1. Deliveries are made exclusively within Poland via couriers and parcel lockers. Shipping costs are dynamically calculated depending on the number of products ordered and will be provided at the finalization of the order.
6.2. Free shipping may be available based on discount coupons or upon meeting certain conditions, e.g., for users who have an account in the store.
6.3. The order processing time is a maximum of 21 working days from the moment the payment is recorded. The usual order processing time is from 1 to 7 working days.
6.4. In case of delivery delays, the Customer has the right to set an additional deadline for the Seller to fulfill the order. If the Seller does not deliver the goods within this period, the Customer has the right to withdraw from the contract.
7. Right to Withdraw from the Contract
7.1. The Customer has the right to withdraw from the contract within 14 days of receiving the ordered goods, without giving any reason, in accordance with the Consumer Rights Act.
7.2. The Customer is responsible for any reduction in the value of the product resulting from using it in a manner beyond what is necessary to determine the nature, characteristics, and functioning of the item.
7.3. The returned product must be in an intact condition, with original tags and seals, if such were attached. Breaking the seal may result in the refusal of the return if it indicates usage beyond the necessary examination of the item’s characteristics, nature, and functioning.
7.4. The store reserves the right to refuse the return of goods that show signs of use, are damaged, dirty, or have been stripped of original seals and tags in a manner indicating usage.
7.5. The Customer bears the direct cost of returning the goods unless the seller has agreed to cover them or has failed to inform the customer of the need to bear these costs.
7.6. To exercise the right of withdrawal, the customer must inform the store via email and return the goods to the address provided.
7.7. The Customer may withdraw from the contract by submitting a declaration electronically. A withdrawal form template is available on the store’s website. Upon receiving the declaration, the store will promptly confirm its receipt electronically.
7.8. The Seller will refund all payments made by the Customer no later than 14 days from the date of receipt of the withdrawal declaration. The Seller may withhold the refund until the returned goods are received or until the Customer provides proof of their return, whichever occurs first.
8. Product Availability
8.1. The store reserves the right to change the offer and withdraw products from sale at any time.
8.2. In the event of the ordered product being unavailable, the Customer will be promptly informed, and the order amount will be refunded within 14 days.
9. Complaints
9.1. In case of physical or legal defects of products, the Customer has the right to file a complaint in accordance with applicable law.
9.2. Complaints should be submitted via email to returns@overrevel.com, providing the Customer’s details, order number, and a description of the defect.
9.3. The Seller will consider the complaint within 14 days of its receipt and inform the Customer of the resolution. Lack of response within this period means the complaint has been accepted.
9.4. If the complaint is accepted, the Customer has the right to demand repair of the product, replacement with a new one, price reduction, or withdrawal from the contract if the defect is significant. The Seller will fulfill the Customer’s request in accordance with applicable law.
10. Dispute Resolution
10.1. Any disputes arising from contracts concluded via the online store will be resolved by the competent common courts in accordance with the provisions of the Code of Civil Procedure.
10.2. The Customer has the option to use out-of-court complaint and claim procedures, such as mediation or arbitration. Detailed information is available on the website of the Office of Competition and Consumer Protection.
10.3. The Customer may also use the EU’s Online Dispute Resolution (ODR) platform available at: https://ec.europa.eu/consumers/odr.
11. Personal Data Protection
11.1. Detailed information regarding personal data protection and privacy policy is available in a separate document: Privacy Policy, accessible on the store’s website.
11.2. Information about the use of cookies can be found in the Cookie Policy available on the store’s website.
12. Final Provisions
12.1. Changes to the Terms and Conditions do not affect the rights and obligations of the parties arising from contracts concluded before the changes were introduced. The Customer will be informed about changes to the Terms and Conditions electronically. In case of lack of acceptance of the changes, the Customer has the right to discontinue using the store.
12.2. Changes to the Terms and Conditions come into effect on the date indicated by the Seller, not shorter than 14 days from the date of their publication on the store’s website. Contracts concluded before the change of the Terms and Conditions are executed based on the Terms and Conditions valid on the day of placing the order.
12.3. The Customer will be notified of changes to the Terms and Conditions when placing an order.
12.4. The Seller does not stipulate a minimum duration of the consumer’s obligations resulting from the contract.
